Court grants nnamdi kanu bail


A Federal High Court in Abuja has released
the detained leader of the Indigenous
People of Biafra, Mr Nnamdi Kanu on bail.
Justice Adeniyi Ademola admitted him to
bail unconditionally while ruling in an
application filed and argued by his lawyer
Vincent Obeta.
In the ruling, Justice Ademola who had last
month granted permission to the
Department of State Service to detain Mr
Kanu for 90 days, set aside the order.
According to him, the continued detention
of Mr Kanu after two months without trial
violates Section 158 of the Administration of
Criminal Justice Act 2015 and Section 35 of
the 1999 Constitution.
Justice Ademola also said that there was
no law that permits the DSS or any other
security agency to detain any Nigerian
beyond two months when in actual fact
there was no intention to put the person on
trial.
He added that from the available facts
before the court, the Department of State
Services were not ready to grant bail or put
Mr Kanu on trial.
While still pondering what to do, the court
holds that his continuous detention is illegal
and as such he is to be released on bail
unconditionally, especially in the light of the
deposition of the counsel to the DSS that it
has no charge against Mr Kanu in any
Court of Competent Jurisdiction in Nigeria.
A Magistrate Court in Abuja had discharged
the Director of Radio Biafra, Nnamdi Kanu,
following the withdrawal of the charges
proffered against him by the Department of
State Services on Wednesday.
Counsel to the accused, Vincent Obeffa, told
Channels Television that with the court’s
ruling, the accused had no criminal cases
against him in Nigeria or anywhere in the
world and as such, he was a free man.
